Article 1: Purpose

The General Conditions of Sale described below detail the rights and obligations of the seller and the buyer in the context of the sale of the following goods: wedding dresses, cocktail dresses, bridal accessories, services. Any sale of goods or services performed by the Seller therefore implies the unreserved adherence of the buyer to the present General Conditions of Sale which the buyer admits to having read prior to his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the website www.atelieremelia.com is not directly related to his professional activity and is limited to a strictly personal use and on the other hand to have the full legal capacity allowing him to commit himself to the title of these general terms and conditions of sale. The company SAS ATELIER EMELIA retains the possibility to modify at any time these general conditions of sale, in order to comply with any new regulations or with the aim of improving the use of its site.

Article n°2: Products

The products offered are those listed on the website www.atelieremelia.com of the company SAS ATELIER EMELIA within the limits of available stocks. SAS ATELIER EMELIA reserves the right to change the product range at any time. Each product is presented on the website in the form of a description containing its main technical characteristics. The photographs are the most faithful possible but do not commit the Seller. The products presented on the website www.atelieremelia.com are sold to all buyers living in countries that fully allow the entry into their territory of these products.

Article n°3: Prices

The prices appearing on the product sheets of the internet catalogue are prices in Euros (€) all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of products. The company SAS ATELIER EMELIA reserves the right to change its prices at any time, however being understood that the price shown in the catalogue on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased according to the total amount of the order. In metropolitan France, a package of participation in the shipping costs will be invoiced to the buyer in the amount of 20 euros TTC.

Article n°4: Orders and payment terms

Prior to any order, the buyer must create an account on www.atelieremelia.com. The account creation section can be accessed directly from the sidebar. At each visit, the buyer, if he wishes to order or consult his account (order status, profile, etc.), must identify himself using his logins. The company SAS ATELIER EMELIA offers the buyer to order SAS ATELIER EMELIA and settle its products in several steps by credit card according to the following terms: The buyer selects the products he wishes to order in the “shopping cart”, modifies if necessary (quantities, references, etc.), checks the delivery address or fills in a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the method of payment by credit card. The next step is to check all the information, read and accept the present general terms and conditions of sale by ticking the corresponding box, then invite him to validate his order by clicking on the button «Confirm my order». Finally, the buyer is redirected to the secure interface in order to safely inform his personal credit card references. If the payment is accepted, the order is registered and the contract definitively formed. Payment by credit card is irrevocable. In case of fraudulent use of it, the buyer may demand the cancellation of the payment by card, the sums paid will then be recredited or returned. The holder of a bank card is not liable if the contested payment has been proven fraudulently made, remotely, without physical use of his card. In order to obtain the refund of the fraudulent debit and any bank charges that may have been incurred as a result of the transaction, the cardholder must contest, in writing, the withdrawal from his bank within 70 days of the transaction. The amounts deducted shall be reimbursed by the bank within a maximum period of one month after receipt of the written objection filed by the holder. No costs for the return of sums may be borne by the holder. The confirmation of an order implies acceptance of the present conditions of sale, the recognition of having full knowledge of them and the renunciation of taking advantage of its own conditions of purchase. All the data provided and the recorded confirmation will be proof of the transaction. If the buyer has an e-mail address and has filled it in on his order form, SAS ATELIER EMELIA will send him an e-mail confirmation of the registration of his order. Article 5. Retention of title

The company SAS ATELIER EMELIA retains full ownership of the products sold until the perfect collection of the price, in principal, fees and taxes included.

Article 6. Withdrawal

Pursuant to Article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise his right of withdrawal and thus return the product to the seller for exchange or refund without penalty, with the exception of the return costs.

Article 7. Delivery

Deliveries are made to the address indicated on the order form which can only be within the agreed geographical area. Orders are placed by UPS, delivery service with tracking, delivery with signature. Delivery times are given for information purposes only; if these exceed thirty days from the date of the order, the contract of sale may be terminated and the buyer reimbursed. SAS ATELIER EMELIA may provide the buyer with the tracking number of his package by e-mail. The buyer is delivered to his home by the UPS deliveryman. In case of absence of the buyer, he will receive a notice of passage and a proposal of delivery. The risks associated with the transport shall be borne by the purchaser from the moment the items leave the premises of SAS ATELIER EMELIA. In case of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 8. Guarantee

All products supplied by SAS ATELIER EMELIA benefit from the legal guarantee provided by Articles 1641 and following of the Civil Code. In case of non-compliance of a product sold, it may be returned to the company SAS ATELIER EMELIA who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by post at the following address: SAS ATELIER EMELIA 5 rue Serpente 77140 Nemours France , within 30 days after delivery.

Article 9. Liability

The company SAS ATELIER EMELIA, in the distance selling process, is bound only by an obligation of means. Its liability may not be incurred for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, breakdown of service, or other unintended problems.

Article 10. Intellectual Property

All elements of the website www.atelieremelia.com are and remain the intellectual and exclusive property of SAS ATELIER EMELIA.  No one is authorized to reproduce, exploit, or use in any way, even partially, elements of the site whether in the form of a photo, logo, visual or text.

Article 11. Personal data

The company SAS ATELIER EMELIA, undertakes to preserve the confidentiality of the information provided by the buyer, which he would have to transmit for the use of certain services. All information concerning him is subject to the provisions of Law No. 78-17 of 6 January 1978. As such, Internet users have the right to access, modify and delete information about themselves. Article 12. Dispute Resolution

The present conditions of distance selling are subject to French law. For all disputes or disputes, in the absence of amicable resolution, the dispute will be brought before the Commercial Court of Melun (France).
